The Supreme Court today stayed the operation of the controversial 27 per cent quota for “other backward classes” (OBCs) in publicly-funded higher educational institutions. Corporate India has welcomed the Supreme Court stay on the central legislation providing for 27% reservation for OBCs. Youth for Equality, a student grouping which spearheaded the anti-quota stir, today welcomed the verdict. NCP chief Sharad Pawar on Thursday termed as “unfortunate” the Supreme Court order. Students of Indian Institute of Technology-Kanpur also hailed the interim stay. Calling the verdict retrogade CPI today sought the intervention of the Parliament for ensuring social justice. The architect of the bill Union HRD Minister Arjun Singh vowed to strictly adhere to the quota law despite the verdict. The BJP came down heavily on the government for its poor preparation reflected by the verdict.
While the IITs look set to drop OBC quotas from JEE, Offstumped feels the celebrations by the anti-reservation movement are premature. In comments that put the SC Interim Stay into perspective, Congress spokesperson and lawyer Abhishek Singhvi spelled out where the Government’s next moves will likely head. He said the court had not stigmatised the concept of reservation per se but has called for a better factual database as the basis for fixing the quota. In its interim order staying the Central Educational Institution (Reservation in Admission) Act of 2006, the Supreme Court held that the 1931 census could not be a determinative factor for identifying the OBCs for the purpose of providing quota.
While the Supreme Court’s rationale for the interim stay is one reason to caution against premature celebrations, the other and more serious reason is the overwhelming political consensus behind OBC Reservations. While the Congress lead UPA counts many mandal Social Justice parties in its ranks from the DMK, PMK combine down south to Lalu Yadav’s RJD up north, the Communists have been pretty consistent in their support for reservations, the CPI-M’s stance on creamy layer notwithstanding. The two big mandalite social justice parties in parliament Samajwadi Party and the Bahujan Samaj Party are solidly behind OBC Reservations. For the BJP for all its reluctance to play the caste card explicitly by taking refuge in “kamandal” instead of “mandal”, the reality is the large increase in the number of OBC MPs and MLAs in its ranks. All in all there is no political force amongst mainstream political parties with an anti-reservation agenda. The Supreme Court verdict notwithstanding the overwhelming political consensus will ensure OBC reservations returns in one or the other.
The argument against OBC reservations in IITs and IIMs when OBC reservations are a reality in engineering and medical colleges across the country is not sustainable. There cannot be a piecemeal approach to victory in the fight against reservations. The anti-reservation movement cannot expect the IITs and the IIMs to be treated as holy cows when their counterparts in the rest of the country are subject to OBC quotas. The only way to rid the nation of the scourge of Reservations is to win the political battle against the dubious politics of Social Justice.
Offstumped had on 15th Jan declared war on social justice in the wake of the Supreme Court ruling on the Ninth Schedule of the Constitution. Subsequently on 20th Jan when the Tamil Nadu Governor demanded the Centre re-write the Constitution in the name of Social Justice, Offstumped had warned of a Culture of Entitlement which is at the root of the politics of Social Justice. Ever since Arjun Singh let out the genie of OBC Reservations, there has been a concerted attempt by a new age of Social Scientists like Yogendra Yadav to give a new spin to the Social Justice debate with fancy formulations like “Affirmative Actions”. The Supreme Court Interim Stay is bound to see further concerted efforts to bring back OBC quotas through the more politically correct “Affirmative Action” route if not through the questionable Reservations route.
Offstumped Bottomline: With the UP Assembly polls around the corner one must expect to see concerted political moves to work around the Supreme Court interim stay on OBC Quotas in the elite educational institutions. It is premature to celebrate. Unless the political battle against dubious politics of Social Justice is decisively won, reservations are here to stay. In order to win that political battle, the Anti-Reservation movement must go beyond picketing the roads in New Delhi and self immolations to get to the roots of the Culture of Entitlement that pervades Indian Society.
Unless society at large rejects Entitlement, the populist politicians will always use Social Justice as the short cut to Political Office.

Apollo – either that or present themselves as an effective voting bloc that can swing elections either way and thus negotiate with mainstream outfits for explicit guarantees on this issue. Right now there isnt any mainstream political support for them, if anything at all you have a reluctant BJP and a CPI-M that talks to both sides which counts for little.
It is a can of worms that has been opened in educational and eventually, corporate cultures that are among the most open-to-all environments in India. It is only the Supreme Court which can keep the Indian constitution from being trampled on by the political machine. The BJP is in a catch-22 situation, its elite may be willing to adhere to principles, but most of its MP’s are “OBC” and “SC/ST” who want to protect themselves…every other political party sees this is an excellent way to gain votes.
Entitlement is a narcotic in democratic society. Once the nasha kicks in, it’s very hard to let go without serious damage to anyone or party trying to wane the drug off from a society.

I have a query. I would be grateful if someone entertains it. Can a person who originally belongs to SC category get converted to General category since he has qualified education on his own merit?
His family is economically well off. Is there a declaration that needs to be filed that he or his family or his future generations would not avail any quota benefit etc in future?
The purpose is to be out of the SC records maintained and be in general category.

Hi, In the SC Verdict the below is being pointed out and this is how the Govt of India is interpreting it =>
Mr. Justice Bhandari virtually ruled out any quotas for OBCs in the IIMs, saying that a graduate (the basic qualification to enter IIM) was educationally forward and “ineligible for special benefits.” Since three of the Judges had stated that graduation was the benchmark for determining backwardness, it was interpreted to mean that graduates from among OBCs would be ineligible for admission to IIMs.
But, significantly, while Mr. Justice Bhandari talks about the exclusion of ‘graduates,’ Mr. Justice Pasayat favours the identification of the socially and educationally backward classes with ‘graduation’ as the basis; nowhere does he talk about excluding graduates. Thus, Mr. Justice Bhandari’s observations must be construed as a minority view that is not binding on the other four judges, it is being pointed out.

I passed out of an IIT and an IIM.
I am a Kayastha. But there is a class of Ghoshs who are “gowalas” (i.e. Yadavs). I wonder if my parents/ grandparents erred. While they were fleeing to India during partition, they should have declared themselves lower caste or something like that. I would not have to work so hard; sigh!
There will be one great (and good) fallout of this.
The education at IIMs are already very expensive (when I passed out 13 years ago, my total expense including hostel fees was a grand total of 55K for two years – lucky me!). The IITs will also catch up in the cost of education soon enough. In fact I think the cost differential between IIT/ IIM and any leading US University will be negligible.
US Universities have started establishing Indian campuses. I think the really good guys will shift to those campuses – why pay so much and get substandard living conditions in IIT/ IIM hostels and get sub standard facilities for education? (the class benches are broken, rooms are ill lit and ventilated, etc).
That will be the start of the decline of brand IIT/ IIM. I hope I am not alive then. Who wants to be branded a loser?
In future Infosys, Wipro,Satyam,HCL and other MNC’s are careful in selecting recruitment proceedure.

Pro reservationationists ironically favour Muslims who only speak Hindi at home or Nayudus and Reddys who speak only Telugu at home. At the same time they treat Tamil-speaking Brahmins and Chettiars as foreign invaders by excluding them . They also claim to fight for the Tamil cause….by dividing Tamil society!!? PMK, DMK, ADMK etc reject creamy layer, support the cruel 2-tumbler system of Southern Tamil Nadu and now demand extended reservation. PMK leader will go Delhi, Hyderabad and Bombay to promote reservation rather than setting up Tamil learning centers in those places. This shows that Tamil Nadu policitians don’t mind loosing their self respect and prefer to worship their Hindi masters than to work for an integrated Tamil society. Incidently the PMK health minister has made Hindi compulsory for medicine, the the DMK surface transport minister has made Hindi compulsory on national roads even in Tamil Nadu.
It is quite intesting to see that these ‘Tamil’ parties are discretely pushing Hindi people on Tamilnadu’s reserved list even though they publicly known to be ‘guardians of Tamil’.
In TN, there are some courses and streams which offers as little as just 1 seat or NO SEAT for the open category candidates. Just imagine the state of affairs for an almost 20% of so-called FCs in the state, with most of them really meritorious. It’s nothing less of an ethnic cleansing happening over there.
